PROJECT DESCRIPTION AND LOCATION:  A master planned community consisting of approximately 2,630 residential homes of varying housing types, a maximum of 110,000 square feet of commercial uses, a fire station, 37 public and private parks, 18.3 miles of trails, and 1,192 acres of permanent biological open space.  The project also proposes the physical widening of Deer Springs Road to four lanes, improvements to the Interstate 15 ramps, Twin Oaks Valley Road within the City of San Marcos, and a number of other road improvements throughout the County of San Diego. 

In accordance with the State Mining and Reclamation Act, a Statement of Reasons is being considered for the elimination of access to the 610 acres of MRZ-2 land that are located with the proposed biological preserve, common open space areas, and the development footprint.

A General Plan Amendment is proposed to modify the Circulation and Land Use Elements, and the Bonsall Community and North County Metropolitan Subregional Plans.  The amendment to the Circulation Element would change the current classification of Deer Springs Road from a four lane Prime Arterial to a six lane Major Road and eliminate a small unimproved segment of Buena Creek Road from the Circulation Element Maps.  The amendment to the Land Use Element would result in an on-site northerly shift of the Current Urban Development Area (CUDA) and Estate Development Area (EDA) Regional Category Boundaries.  The amendments to the Bonsall Community and North County Metropolitan Subregional Plans would result in the addition of language to describe the subject project.

The Zone Reclassification would result in changes to all applicable development regulations.  The seven Use Regulations currently applicable to the project site would be changed to C36 General Commercial, RM22 Multiple Family Residential, and S88 Specific Plan.  The zone reclassification would also modify the existing boundaries of the “B” Community Design Review Area and “D” Design Review Special Area Designators.  Other development regulations that would change include setbacks, height, floor area ratios, and more.

An amendment to the County of San Diego Resource Protection Ordinance (RPO) is being sought to include an exemption for Merriam Mountains project which would require conformance to the project’s Resource Protection Plan, the functional equivalent to the County’s RPO.

A Specific Plan is proposed for the systematic implementation of the proposed project which identifies permitted uses and their proper location, project phasing, and site design criteria.

A Vesting Tentative Map is proposed for the subdivision of 58 lots for the creation of a maximum of 1,238 lots for the development of the project.  The subdivision would result in the creation of 2 commercial lots, 1 multi-family lot, 14 variable residential lots, a maximum of 1,168 single-family residential lots, and lots for parks, open space, water tanks, and other ancillary uses.

A Site Plan has been prepared pursuant to the “B” Special Area Designator for conformance review with the I-15 Corridor Scenic Preservation Guidelines, the proposed “V” Setback Designator to establish setbacks for the proposed project, and Section 81.1206 of the County’s Subdivision Ordinance for vesting maps.

 

 

The 2,327 acre Project is located northwest of the Interstate 15 / Deer Springs Road interchange, in the North County Metropolitan Subregional and Bonsall Community Plan areas, within the County of San Diego.

 

SUMMARY OF ORDINANCE:   

Amendments to the following ordinances are proposed:

An amendment to the zoning maps, to change the existing Use Regulations from A70 (Limited Agricultural), C36 (General Commercial), M52 (Limited Impact Industrial), RR.5 (Rural residential), RR.25 (Rural Residential), S82 (Extractive), and S92 (General Rural Use) to C36 General Commercial, RM22 Multiple-Family Residential, and S88 Specific Plan and modify the boundaries of the “B” Community Design Review and “D” Design Review Special Area Regulations.  The Zone Reclassification would also amend setbacks, height, floor area ratios, and other development regulations.

An amendment to the Resource Protection Ordinance, to add an exemption for the Project (the “RPO Amendment”).  The RPO Amendment requires the Project and associated off-site improvements to be consistent with a Board of Supervisors’ approved comprehensive Resource Protection Plan.

ENVIRONMENTAL REVIEW:  An Environmental Impact Report has been prepared for this project and is on file at the Department of Planning and Land Use as Environmental Review (ER) No. 04-08-028.

The applicant’s proposed revision would delay the timing for constructing or entering into a secured agreement to construct the onsite Pepper Tree Lane improvements (bridge construction), from Unit 8 to Unit 9 or 10.

NOTICE OF

PUBLIC HEARING

NOTICE, pursuant to the State of California Health and Safety Code Section 40725, is hereby given of a public hearing on February 24, 2010, at 9:00 a.m., before the Air Pollution Control Board of the County of San Diego, in Room 310, County Administration Center, 1600 Pacific Highway, San Diego, California, for the purpose of receiving public comments on and considering amendments to amended Rule 69.3.1 - Stationary Gas Turbine Engines - Best Available Retrofit Control Technology. 

 

Proposed amended Rule 69.3.1 implements the California Health and Safety Code requirements to adopt rules reflecting every feasible measure to control nitrogen oxide (NOx) emissions.  The rule applies to existing stationary gas turbines with a power rating of 1.0 megawatt (MW) or greater and to new turbines with a power rating of 0.3 MW or greater.  The amendments to Rule 69.3.1 will establish daily NOx mass emission limits for older peaking turbines, resulting in NOx emission reductions by an average 0.9 tons/year.  Additionally, the amendments will provide limited exemptions from the rule standards beyond those already provided in existing Rule 69.3.1 for certain types of startups for combined-cycle turbines and for periods of operation at low load for turbines equipped with lean premix combustors.  These limited exemptions are estimated to increase actual NOx emissions by about 0.25 tons per year in San Diego County.  These exemptions are likely to be most significant for two existing large combined-cycle turbine power plants in the county.  The rule amendments will specify new definitions and new monitoring and recordkeeping requirements to support the proposed mass emission limitation and limited exemptions.  The amendments include other minor changes and clarification to the rule provisions.

NOTICE OF PUBLIC HEARING

NOTICE, pursuant to State of California Health and Safety Code Section 40725, is hereby given of a public hearing on February 24, 2010, at 9:00 a.m., before the Air Pollution Control Board of the County of San Diego, in Room 310, County Administration Center, 1600 Pacific Highway, San Diego, California, for the purpose of receiving public comments and considering repealing Rule 66 (Organic Solvents) and in its place adopting Rule 66.1 (Miscellaneous Coating Operations and Other Processes Emitting Volatile Organic Compounds).

Initially adopted in 1972, Rule 66 was the first rule to control emissions of organic compounds from stationary sources in San Diego County.  It is now used as a “catch-all” rule that applies to processes and operations not covered by source specific rules regulating volatile organic compound (VOC) emissions.  However, Rule 66 has an outdated concept of photochemical reactivity and does not reflect the recent advances in low-emitting cleaning materials.  The Air Pollution Control District (District) proposes to replace it with new Rule 66.1 that will include a current definition of photochemically reactive organic compounds, specify VOC content limits for cleaning materials used for surface and coating application equipment cleaning, provide recordkeeping requirements for the users, manufacturers and distributors of VOC containing materials and update test methods. The new rule is also reformatted to conform to other rules regulating VOC emissions.

Proposed Rule 66.1 will fulfill the District’s commitment in the San Diego County Regional Air Quality Strategy to implement all feasible control measures as required by State law, and will satisfy federal requirements to implement Reasonably Available Control Technology.  Rule 66.1 will apply to new facilities upon rule adoption and to existing facilities 12 months after the date of rule adoption, at which time current Rule 66 will be repealed.

Rule 66 is presently included in the federal State Implementation Plan (SIP) for San Diego County.  Proposed new Rule 66.1 will be submitted to the Environmental Protection Agency to replace Rule 66 in the SIP.

PROJECT DESCRIPTION:  This is a request for a zone reclassification and open space easement vacation to accommodate the future Rancho San Diego Sheriff Station.  The approximately 25,000 square foot facility would be located on a 13-acre County owned property on Highway 94 (Campo Road), east of the Skyline Wesleyan Church facility, within the Rancho San Diego Specific Plan and Valle de Oro Community Plan Area.  The open space easement vacation would vacate two portions of an existing open space easement shown in the attached figure, equivalent to 0.3-acre under the Streets and Highways Code (Sections 8324).  An open space easement consisting of approximately 0.5-acre would be located on the project site to replace the vacated open space easement.  The zone reclassification would exchange the use regulations on portions of the site from S80 Open Space to M52 Limited Impact Industrial.  The open space easement vacation would vacate portions of an existing open space easement.  Replacement mitigation for the vacated open space will be located on the project site.  (Thomas Guide Page 1271/H6). 

 

LOCATION:  The project is located on State Highway 94 (Campo Road), east of the Skyline Wesleyan Church facility within the unincorporated areas of San Diego County.

 

ENVIRONMENTAL STATUS:  A Mitigated Negative Declaration for the Rancho San Diego Sheriff’s Station dated February 2, 2009 was previously adopted by the San Diego County Board of Supervisors on May 5, 2009 on file with DPLU as Environmental Review Number 09-19-004 as explained in the Environmental Review Update Checklist dated September 25, 2009.

PLANNING COMMISSION RECOMMENDATION: On September 25, 2009 the Planning Commission recommended approval of the zone reclassification.

SUMMARY OF ORDINANCE: This item would modify the definition of a Priority Development Project set forth at Section 67.802(w) of the County Watershed Protection, Stormwater Management and Discharge Control Ordinance, to include all pollution generating development projects of one acre or more in size and to make minor changes to subparts (1)(B) and (2) of the definition of priority development project. This modification is required to meet the requirements of the Municipal Stormwater Permit, National Pollution Discharge Elimination System Order No. R9-2007-0001, (Permit) issued by the San Diego Regional Water Quality Control Board in January 2007.  The item is requested to be approved on an urgency basis to ensure compliance with the Permit and to ensure protection of public health and welfare from the adverse effects of potential water pollution and land disturbance.

ENVIRONMENTAL REVIEW:  Thisaction is not subject to review under the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15060(c)(3) because the activity is not a project as defined by Section 15378 of the State CEQA Guidelines.

The ordinance updates and clarifies language to more accurately describe the scope of existing programs, and provides consistency with California Penal Code Section 597.1 and California Legislative Policy as listed in Penal Code Section 599d and Food and Agricultural Section 17005, as well as the public’s expectation of the department’s responsibility.
